我們快要淪為「罪犯」了（二）！

□編按：本篇文章所介紹之法條，請參閱行政院版＜著作權法修正案＞條文第3條、80條之1～2、90條之3，及96條之1。

……當行政院版＜著作權法修正案＞完成立法程序，台灣正式躍昇為「智慧共和國」後，我們必須擔心，太過天才的小孩，因一時衝動與好奇，而嚐試去破解具有防止拷貝功能的光碟，因為那將迫使天才的小孩忽然淪為「罪犯」！……

依據既有的法律規範與常識性的行為價值來說，任何一樣東西被購買之後，購買者就擁有了絕對的處置權力，除非處置的方式危及了公共利益，才受到法律規範，否則，購買者愛怎麼變造，想如何改裝，都是他（或她）的絕對自由！而且，這也是肯定跨讚某些人具有創新發明才能的日常經驗。

然而，若讓目前的行政院版＜著作權法修正案＞通過，上述的一切就180度地顛倒過來了！倘若，未經著作權人（實際上是企業財團）同意，不得擅自破解或改裝著作權人在其物品上「加密」之科技保護措施，而且，這些科技保護措施的技術與設備不得任意製造、輸入或提供人民大眾使用。違反者處一年以下有期徒刑，拘役或併科新台幣2萬以上、20萬以下的罰金。

表面上，這是名之為“科技保護”，實質上，這是經由「國家公權力」以確保財團得以獵取更貪婪的利潤！而結果是，人們使用東西的基本自由被剝奪了！人們變造改裝的摸索樂趣被禁絕了！鼓勵人們創新發明的價值取向，被硬生生地扭轉成「犯罪」了！

我們也必須擔心，小孩為了打工賺零用錢而去販賣違反“科技保護”措施的商品，如大家熟知的色情頻道「解碼器」！

我們更必須擔心，我們所購買的東西是否具有“科技保護”措施、別人贈送的東西是否具有“科技保護”措施，以及家中原有的東西是否具有“科技保護”措施，否則，一不小心，就被自己、家人或小孩搞“破壞”，在洋洋得意之際，卻喪失大好前程，吃牢飯，從此冠上刑事犯的污名，一輩子遭到社會歧視與排擠！

在「智慧共和國」的日子裡，自保之道無它，就是趕快認識巴結法官，以便能敦請他（或她）免費地為你全家開“讀書會”，逐條逐句逐字地解讀闡述艱深而語意不清的＜著作權法修正案＞，才不會在不知不覺中誤觸法網，毀了你和一家人的未來！
若無緣認識巴結法官，至少也要認識巴結檢察官。若只找得到律師，則其解讀闡述的可靠性與正確性要大打折扣，因為，前兩者是執法者，才知道“合法”與“違法”之間的明確界線，律師充其量不過是訟棍，不能完全精確掌握法官與檢察官“自由心証”式的裁量尺度！

假使，你的人脈關係實在太有限，你的社會交往實在太封閉，連律師也不攀不上，那只剩下最後一途：

動員全家人去蒐集有關＜著作權法修正案＞的所有訊息，這包括文章、書籍與演講，以及課程，切記，一定要花錢購買，而且，絕不能再拷貝！還要留下發票，以資充份証明，你是「花錢購買」的，這是＜著作權法修正案＞的唯一目的！

最最重要的是，你和全家人都要拿出這輩子最用功的態度去研讀學習，務求徹底搞懂弄通，這有兩大好處；一，是保証你和一家人必將成為「智慧共和國」下的“良民”！二，能搞懂弄通＜著作權法修正案＞者幾希矣，所以，你可以靠講授諮詢＜著作權法修正案＞收費，除了能撈回之前的投資，說不定，還能大賺一筆！

有一個簡單的方法可以抗議「影音娛樂工業」無止盡的貪婪

就是相關產品只要有「防複製」等加密裝制的…一律不買

商人可以亂搞…至少我們也有「拒買」的權力吧

流行樂…聽聽廣播、看看音樂台就是了，不必買這些東西

如果被這加密系統「圈禁」的“音樂人”是妳/你所欣賞而「不能割捨」的話…

還有買「二手CD」或「多人合購一張專輯」等方式可以參考
前提是妳/你要能明白的抗拒娛樂商人的行銷、包裝手段

還有一個重要的動作…就是要設法讓妳/你所支持的“音樂人”
(或藝人、歌手、創作人)知道我們在支持他們的同時，對這些商業手段的「深惡痛決」
(可以在歌友會、非官方網站表達我們的想法)

要求他們(音樂人)在考量商業合約的同時…也把Fan`s們關於這部份的心聲考慮進去，在簽下下一張合約的時候…選擇待在一個不剝削「真正的音樂人」＆「消費者」的公司(相對而言)

如果這個藝人…認為他必需靠這些不合理的「商業行銷＆包裝」手段才能獲利，而不願正視我們的想法的話…

我們是否可以這麼說__這也代表這傢伙並不值得Fan`s們如此的支持？

也就是說…支持「好的音樂」並不需要連帶認同它們背後的「利益共生」結構

而我們也要讓那些搞音樂的人們明白…他們沒有義務為那些商人背書…

最後…也是希望全球的「華人音樂」市場，能夠健康的發展
不要輕易的被跨國資本淹沒

讓更多的、還有點「理想性」的獨立發行公司生存下去吧
