〔記者王志宏╱台北報導〕立法院經濟委員會今天將審查著作權法修正草案，多個以學生為主的社團昨天召開記者會，質疑官方版草案過度屈服於美國三○一條款壓力，若照案通過，複製光碟不論牟利與否，只要被認定有傳播意圖就是公訴罪，還有複製文章、店家任意播放音樂ＣＤ都將觸法，他們要求先開公聽會、暫緩修法。

由台大、輔大、中興及東海等多個學生社團組成「反智財惡法行動聯盟」，昨天在親民黨立委高明見等人安排下在立法院召開「台灣奇蹟、全民入罪」記者會，以表演「全民斬首」的行動劇抗議修法過於嚴苛，他們今天也要到法務部演出行動劇，表達抗議。

行動聯盟成員指出，在美國三○一名單將公布的壓力下，這次著作權法修正及新增共五十三條，可謂大翻修，對社會各個層面影響極大，如上網複製文章將可能動輒觸法；複製光碟不論牟利與否，就是公訴罪；店家播放音樂ＣＤ將犯法；海關可對貨品主動查扣，不負任何責任，種種修法，將陷台灣大多數民眾於動輒違法的不義處境，他們要求立院暫停修法，召開公聽會。

立委高明見及李永萍指出，法律貴在可行，如果不顧及執法效率及民眾權益，就等於是在羞辱法律，行政院版本過於嚴苛，複製光碟不論牟利與否，只要被認定有傳播意圖或行為就是公訴罪，或是上網下載文章也可能會觸法，就可行及執法能力上都令人質疑，因此親民黨團主張先開公聽會暫緩修法，黨團也將提黨團版併案審查。

立法院經濟及能源委員會今天將審議著作權法部分條文修正案，反智財惡法行動聯盟昨天前往立院抗議，指出政府屈服於美方壓力，制定空前嚴峻的刑罰，新條文將導致「全民入罪」，要求立法院暫緩修法，召開公聽會，尋求共識；並且強烈反對將侵害著作財產權行為改為公訴罪。

反智財惡法行動聯盟表示，美方將於4月底公布本年度301條款觀察名單，在美國唱片業和書商強大壓力下，經濟部與法務部「打小孩給美國人看」，提出嚴苛的著作權法修正案，立法院委員會將於今天審議。

聯盟指出，這次修法擴大檢察官主動偵辦的權限，提高罰金額度，加重刑責。以後凡以光碟方式銷售、出租、或意圖散佈侵害著作財產權等行為，都屬「非告訴乃論」（公訴罪）。如購買電影光碟片後自行拷貝一張送給朋友，檢察官都可主動偵辦。

另如「暫時性重製」將列入重製範圍，但暫時性重製的定義卻未明確規定，充滿灰色地帶和解釋空間，導致未來若上網找圖片，然後儲存在電腦硬碟中，可能也違反暫時性重製條款。

再如修正條文禁止平行輸入，以後在國外看到喜歡的書或CD，價格又便宜，想多買幾份帶回台灣送人，也可能觸法，政府認為這是保護原創，聯盟認為是保障代理商。

聯盟認為，如此草率野蠻的修法草案，不僅圖利大財團，也讓警政和檢察官權力大幅擴張，「拷貝一張CD要坐牢3年，檢察官也可能只因為一張CD或幾頁影印書前往私人住宅搜索」，聯盟認為，未來資訊的自由流通必須要用昂貴的正版費用來乞求。

聯盟認為最離譜的是，這項修法與學生與民眾權益息息相關，竟未經任何公開民主過程的討論，因此要求暫緩修法腳步，先召開廣泛的公聽會；反對全面設定為公訴罪，要求取消刑罰；也反對為美國量身訂做世界第一的嚴刑峻罰。

立法院今日將審議著作權法修正草案，由於外界認為燒錄機使用普遍，草案擴大公訴範圍，將意圖營利、散佈、出租的燒錄行為，列為公訴，會使得民眾動輒得咎。在野黨立委認為，該案有「全民入罪」之嫌，將串聯提案暫停審議，使該案在本會期過關的規劃可能生變。

立法院經濟及科技聯席委員會預計提案暫停審議著作權法修正案。經濟部昨日緊急開會，針對今天的議程進行沙盤推演，智慧局也到各委員辦公室了解疏通。據了解，目前智慧局態度傾向將本會期通過著作權法修正案，列為第一要務，因此只要能儘速通過法案，內容要怎麼修，智慧局都會尊重立法院的意見。

由學生團體組成的「反智財惡法行動聯盟」二十二日到立法院進行抗議，要求暫緩修法，召開更廣泛的公聽會，並且主張取消刑罰及公訴罪規定，讓著作權侵害回歸民事程序處理。聯盟發言人徐沛然認為，行政院版草案，根本是圖利財團，「打自家小孩給美國人看」，如果容任法案通過，將造成「全民入罪」後果。

有鑑於此，立法委員高明見、高金素梅、周雅淑、李永萍、龐建國、朱鳳芝等，已經開始串聯，遊說經濟委員會召委林豐喜變更議程，並不排除以臨時提案方式，暫緩修法。朱鳳芝辦公室表示，著作權法修正案影響層面複雜、廣泛，有必要先召開公聽會、廣納各界意見後，再行審議。而包括朱鳳芝等已計劃於二十四日召開公聽會，包括學生團體、權利人團體、使用人團體均已表示對此議題的關切，屆時勢必將引起另一番的激戰。

學生團體認為，燒錄機使用如此普遍，著作權法修正草案擴大公訴範圍，將意圖營利、散佈、出租的燒錄行為列為公訴，將使民眾動輒得咎，永無寧日。例如合法光碟擁有者，若想拷貝幾張送給朋友，就可能構成「對特定多數人散佈」而觸法。

著作權法修正草案中，對業者影響最大的，莫過於「擴大公訴」、以及「賦予海關主動查扣權」兩個規定。業者表示，很多時候著作權的侵害，都只是授權合約條文的認定問題，擴大公訴範圍，只是讓原本單純的合約爭議，升高為沒有轉圜餘地的刑事案件，影響下游通路業者的經銷意願。

此外，給予海關對「可疑物品」的主動查扣權，也必須有所限制，否則對商業貨物流通，將形成莫大阻礙。

著作權法修正草案中，將公訴範圍從原來的「常業犯」，擴張到意圖營利、散佈、出租而為的光碟重製行為。此外，為了遏阻國內的盜版光碟流入世界其他市場，並於九十一條之一增訂，海關於執行職務時，發現進出口貨物外觀顯有侵害著作權之嫌者，得主動查扣。

儘管智慧局表示，將對海關查扣權，訂定施行細則，將侵害情況列出不同等級，提供海關執行參考﹔因為海關不當執行，而受損失的業者，也可以請求國賠。但業者對於該項條文，疑慮仍多於支持。

金嗓電腦科技法務室主任林福祥表示，著作權的侵害往往涉及非常細部的認定問題，特別是在授權條款的認定部分。特別是伴唱機或是軟體產品，往往涉及很多的著作物授權﹔有時業者並非故意侵害，只是與權利人在授權合約的範圍上，有不同的看法，此時若以公訴等國家公權力介入，無異升高問題的複雜度，且完全斷絕業者私下協商、和解的可能。

業者對於賦予海關查扣權，也有相當疑慮。有業者即私下表示，台灣能夠接到大廠訂單，成為全世界屬一屬二的預錄式光碟（也就是已經壓製內容的光碟）出口國，靠得就是交貨準時﹔未來如果只要「可疑」就可以查扣，那麼競爭者很容易拿一些契約文件，擾亂海關判斷。屆時，業者因延遲交貨以及失去後續訂單的損失，誰來賠償？

著作權法修正案通過後，第一個倒大楣的就是檔案交換（Ｐ２Ｐ）軟體的提供者。由於著作權法修正草案賦予著作權人「公開傳輸權」，因此未來未經授權，而將檔案上傳，或在網路上與不特定人，或特定多數人交換，都將觸法，面臨刑事責任問題。

所謂Ｐ２Ｐ（peer to peer）技術，指的是一種網路上的傳輸平台，使用者可透過平台，向網路上的同儕（peer），請求傳輸所需檔案。由於目前Ｐ２Ｐ技術，多被用來交換影音檔案，因此被影音業者視為必須剷除的頭號公敵。

目前國際唱片交流基金會（ＩＦＰＩ）與國內二大Ｐ２Ｐ業者KuRo、EzPeer的訴訟，已經在地檢署進行調查﹔而國際間的Ｐ２Ｐ網站更是如雨後春筍般的成立，一個名叫為「afternapster」的網站，甚至蒐集全世界Ｐ２Ｐ軟體網站，供使用者連結。

KuRo目前在台灣、大陸都有設立據點，提供服務。去年光是台灣，KuRo營業額就高達一億九千萬元，會員突破三十萬人。因此也傳出部分唱片業者將營業額的下跌，歸咎於KuRo的出現，不滿情緒甚至蔓延到提供KuRo廣告空間的網路業者Yahoo!奇摩身上。

對此，KuRo感覺無辜，KuRo認為對會員收取每個月九十九元，乃基於軟體平台的提供與維護。

立法院經濟委員會今天將審查「著作權法修正草案」，昨（二十二）日反智財惡法行動聯盟在立委高金素梅、高明見的陪同下召開記者會，質疑行政院是在美方的強大壓力下，「打自家的小孩」給美國人看。為了表達反彈，他們今天上午十時，也將前往法務部「砍頭」給陳定南看。

美方即將於四月底公布今年的「三○一條款」觀察名單，行政院也早在三月中就提出「著作權法修正草案」，預計於今天於立法院經濟委員會展開審查。然而，其中新增有關暫時性重製、擴大公訴範圍的規定，都讓反智財惡法行動聯盟相當感冒。

聯盟昨天由立委高金素梅、高明見陪同召開記者會。常為原住民弱勢代言的高金素梅認為，在原住民的哲學裡，知識、技術都是部落共有的；她質疑，如果知識也要計價，原住民朋友將更顯弱勢。她抨擊美方的強勢態度，是企圖以擁有的財富與知識，讓世界任由富豪階級宰制。

高金素梅以九六年亞特蘭大奧運會中，阿美族郭英男的傳統民謠為例，質疑這場國際侵權官司最後在美國和解，美國代理商僅付出和解金給台灣代理商，郭英男老先生也只收到和解金的一小部份，就簽字完成和解。然而，日後阿美族人要再傳唱這些傳統歌謠，恐怕就要排隊入獄了。

聯盟指出，這項「嚴刑峻法」一旦通過，未來買一張電影ＤＶＤ、再拷貝一份給朋友，檢察官就可依著作權法草案第九十一條重製罪提起公訴，求處五年以下有期徒刑、併科新台幣三十萬元以下罰金。他們說，這些刑責甚至比縱火、教唆殺人致死等罪的刑責還重。

此外，未來學生上網找資料、做報告，把資料複製下來存在電腦中；民眾出國遊玩，好心幫朋友「平行輸入」正版產品，都可能因而觸法。而台灣中小企業也必須多加小心，只要海關認為有盜版之嫌，都可以進行主動查扣，就算事後證明不違法、也不需要負擔賠償責任。
　為此，聯盟今天上午十時也將前往法務部前，演出「斬首示眾」的行動劇，凸顯著作權法修正草案惡陷全民入罪的不合理性。
