智財修法 學生怒吼！

「反對智財惡法行動聯盟」赴法務部抗議的行動目的

由多個學生社團和社運團體所組成的＜反智財惡法行動聯盟＞共三十餘人，於4月23日星期三早上至＜法務部＞前抗議，強烈反對此次行政院對＜著作權法＞的改惡！


此一抗議行動主要訴求為「全民入罪、台灣奇蹟」！並且，要求政府不能屈從美國301條款的壓力，提送超越WTO規範的＜著作權法修正案＞，因為，此法案一但通過，不僅更一面倒地圖利於跨國壟斷財團，更因擴大「公訴」罪的範圍，將造成檢察官四處搜索，嚴重侵害社會大眾知識人權與使用資訊的自由，故而主張應立即擱置＜著作權法修正案＞！

在學生所演出的行動劇中，由＜法務部＞擔任劊子手揮舞著「智慧財產權」的兇刀，將印書、上網、燒CD的人民一一砍倒在地，就地正法！藉此凸顯了目前＜著作權法修正案＞對侵權行為懲以為刑罰的超級荒謬性。現場演出時，參與團體分別強調，在行政院送審的＜著作權法修法案＞中，極為擴大「公訴」罪範圍，這將迫使資訊流通受到阻斷，對於失業勞工、原住民等知識與資訊原本就已取得不易的群體，更加劇壓迫，並拉大貧富差距。

而在昨天召開的記者會上，立委高金素梅表示，現行＜著作權法＞的規定已不能保護實際創作人，而利潤又都被企業財團所賺走！倘若，知識要計價，弱勢團體將會更加弱勢。

政大廣電系郭立昕教授則表示，智慧財產權，是西方霸權國家為了經濟利益強加於別國身上的觀念與制度。如果完全遵守這樣的規則，發展中國家將永無翻身之日！

高明見立委則痛批＜著作權法＞刑責化的嚴苛與極其不合理，一個燒錄光碟的動作，竟和傷害他人生命一樣判處3年刑罰，這在一般觀念上和法理上都是站不住腳的！如今，智慧財產權，早已非保護創作人權益如此單純的想法，而早就是保障企業謀奪暴利的“法器”，如果，社會大眾不能破除這樣的迷思，認清事實，知識與資訊使用者權益將會在美國政府的壓力之下，日益緊縮。而臺灣政府應在政策法律的制定上，扮演捍衛人民權益的角色，而不是充當美國政府對台灣百姓的鎮壓者！
