饒了檢察官吧？

據悉，台灣各地檢察官每月平均承辦的案件高達百餘宗，已呈現出吃不消的狀態，若加上近年失業率暴增所導致治安的急劇惡化，恐怕實際數字絕不止於百餘宗！如果，基於提升司法品質與保障人權的考量，以及體恤檢察官的勞動權益，則執政當局的治標之道是增加檢察官人員的招考培訓，以降低檢察官的平均承辦案件量，治本之道則是“拼經濟”與改革社會經濟結構，以從根消弭犯罪的制度性根源。

然而，執政當局對治標治本兩者皆不為也就罷了，卻還要主動積極地「製造」犯罪！行政院最近提出＜著作權法修正案＞送進立法院審議，該修正案最大的特色，就是把許多所謂“侵犯”著作權的行為，從「告訴乃論」罪加重為「公訴」罪，也就是，把原本不控告檢察官不受理的“侵權”行為，加重至即使著作權人或被侵權者不控告，檢察官也必須偵辦、逮捕與起訴的刑事犯罪！

這下，檢察官可頭大了！

一來，若行政院＜著作權法修正案＞完成立法程序，則台灣民眾將有許多人將莫名其妙地誤觸法網，淪為罪犯，檢察官的承辦案件將成等比級數成長！

二來，凡是研讀過＜著作權法修正案＞的人無不有此感，語意模糊不清，界限曖昧不明，亦即，究竟「合法」與「違法」的分際何在，很難搞懂！是故，一旦＜著作權法修正案＞通過立法院三讀審議，由總統公告頒佈後，台灣所有檢察官都得抽空到＜經濟部智慧財產保護局＞密集受訓，以徹底悟透掌握＜著作權法修正案＞的各項規範，明辨「合法」與「違法」之間區隔，方能“毋枉毋縱”地執法。

不過，按照台灣政府的施政慣性，與筆者的親身耳聞，密集培訓的可能性是趨近於零！因為，目前檢察官已忙得不可開交，何來閒空！再者，曾聽台中縣大里市派出所的一名警員提起，＜家庭暴力防治法＞立法通過年餘，整個台中縣警察除他以外，竟無人知曉如何偵辦家庭暴力犯罪！可想而知，遠比＜家庭暴力防治法＞更複雜艱深百倍的＜著作權法修正案＞，其下場定是絕大多數的檢察官與法官都“莫宰羊”，屆時，如何執法？難道要三天兩頭行文至＜經濟部智慧財產保護局＞要求解釋嗎？礙於顏面，檢察官也不會如此為也！

更要命的是，容易“觸犯”＜著作權法修正案＞者，應以大學生和白領上班族居多，所以，為查緝“罪犯”，檢察官就得經常出入校園與公司辦公室以進行搜捕，到那時，想不遭到扣以「侵犯人權」與「白色恐怖」的嚴厲抨擊，只怕很難！

所以，執政當局行行好，別再因奉承美國政府而大翻修＜著作權法＞，以「製造」大量的「犯罪」了！別再加重執法人員不必要的負擔，讓他（或她）們專心一意地打擊「真正」的罪犯，搞好治安！饒了檢察官吧！也饒了台灣的治安吧！

最後，筆者要呼籲內政部長余政憲，如果你真有心要實現「犯罪率零成長」的政策口號，你務必要跳出來誓死反對＜著作權法修正案＞，否則，光是違反該修正案的“犯罪”案件就會讓台灣的犯罪率呈直線暴增！或許，政策口號不兌現，你已習慣，但是，若監獄人滿為患而引起暴動，那代誌就非常大條了！
