台灣的努力，連美國也望塵莫及？

□編按：這篇文章是由＜工商時報＞的「工商小社論」轉載之，該文提到一項重點，即台灣政府對「智慧財產權」的保護，不但是全球第一，而且連美國政府也莫塵莫及，那麼，我們不僅要問，台灣政府究竟還要剝奪台灣人民多少的知識人權與資訊流通自由，才肯善罷干休？

因應美國即將在月底公布的特別三Ｏ一，立法院這兩天快馬加鞭審查＜著作權法修正案＞，這一大規模的修正案迄昨日止已審完逾半條文，預計五月初再審，以使數位網路時代的智財權獲得更充分的保障。

這十年，台灣保護智財權的賣力程度，舉世無匹，但自一九八九年以來，台灣便成為這份黑榜上的常客，過去這兩年更被列名具高度警戒意義的「優先觀察名單」！對於美方漠視台灣的努力，一再以高標準要求台灣訂定相關法規，卻又把台灣留在三Ｏ一黑榜，各界不平之聲正漸擴大。

老實講，相較於全球這麼多國家對三Ｏ一相應不理，台灣對美方的要求幾乎是有求必應，這十年台灣建立了全球第一個出口軟體監視系統（ＥＭＳ）、實施了全球第一個商標出口監視系統、訂定了全球第一個晶片標示制度、前年又制訂＜光碟管理條例＞，如今為掃蕩盜版光碟又成立專責警力、大修＜著作權法＞，這樣的努力，即或美國政府，恐怕也望塵莫及。

台灣已連續兩年名列優先觀察名單，優先觀察雖沒有立即報復的壓力，惟今年若仍不能降至「一般觀察名單」，這無異是否定了台灣這一年來的努力，勢將使行政部門更難爭取保護智財權的資源，這豈是美國所樂見？

想想看，把台灣由「優先觀察」降至「一般觀察」完全不需多費一毛成本，但觀察監督效果仍在，除可維繫三Ｏ一的效力，更可鞏固美方的利益，在三Ｏ一名單公布的前夕，美方實應審慎思量。
