防疫第一線的護理工作人員是社會最珍貴的資產！

一直擔心的事終於發生了！

ＳＡＲＳ風暴愈演愈烈，＜工傷協會＞早就提出預警，基層勞動者在雇佣關係中，幾乎沒有自主裁量權。在ＳＡＲＳ威脅下，雇主若避免擴大疫情或行業特性受波及而停工，工人就跟著失去薪資！雇主若以生產優先，工人便只好繼續進出危險區執行職務．．．　

突破封鎖線向外界求援的和平醫院護理人員，以「我們不要等死！」的控訴表現出她們的驚恐與委屈，她們不但承擔被感染世紀病毒的危機，還被社會批評為是沒有「職業道德」、未將公眾利益放在前面．．．．．

我們要指出的是，雇主提供勞工安全的工作環境，原就是勞動契約裡不可或缺的要項。營造業工人不會因為爬鷹架會跌死人而拒絕上工，但雇主若未提供安全帶、安全帽等基本設施，工人當然毋需賣命工作！

同樣的，和平醫院的護理人員被留置在強制隔離的醫院繼續工作，但衛生署卻未提供任何相關的支援條件，如ＡＢ幢樓的空調相通、隔離衣重覆使用、未感染區與已感染區的交混夾雜，被召回醫院隔離的，多半是護士與職員，有更多治療與防護的專業知識的醫生卻沒有幾個，護士與職員在保護自己的專業知識及安全設施上幾乎都落空！正是這樣的處境，才逼得工作人員大聲疾呼「我不要得病！」

正如同一個未戴安全索的工人被懸空逼上十樓高的鷹架，和平醫院護理人員的控訴不是罔顧職責，而是保命的呼救！

當全國進入防疫如作戰的階段，基層的護理人員不但需要社會大眾的肯定與打氣，更需要清楚的安全保護政策，既保障工作、薪資免受威脅，也保護人身安全免受感染。

衛生署在防疾措拖的「建立跨部會合作機制」裡，從農委會、陸委會、海巡署、到教育部洋洋灑灑列了八大部會，卻未將勞委會納入！從中鼎員工、到因拒絕出差大陸被解僱的太乙職員，乃至和平醫院的工作人員，可預見的，隨著ＳＡＲＳ防疫時間拉長，愈來愈多的基層勞動者會直接間接地受到工作權、工作傷害的影響，勞委會不能再沈默了。旅遊、飯店業者可以要求政府抒困，被留職停薪、無薪休假、隔離扣薪、違命解僱的工人呢？

勞資關係的不平等，最能夠暴露疾病防治並非人人條件一致！早在ＳＡＲＳ疫情業已爆發，但衛生署還未宣佈為第四類法定傳染病時，就有許多航空公司以「戴口罩有礙美觀」為由，禁止執行香港、新加坡、越南班機任務的空服員戴口罩值勤。此次和平醫院集體感染爆發後，才有工作人員投書表示，院方不准醫護人員戴口罩．．．．．學校兒童尚且知道戴口罩保護自己，但工作現場的勞動者卻沒有保護自己的條件。真要貫徹防疫、減少勞資爭議，勞委會就應該儘早提出防疫時期的勞動解釋及政策；

一、勞委會應主動要求納入ＳＡＲＳ防疫跨部會機制，並積極提出職場上的感染防治與確保勞工在安全環境下工作的政策方案。
二、針對因ＳＡＲＳ疫情導致工資或工作權受損的工人，勞委會應動用＜就業安全基金＞，並訂定全國一致的補助計畫。
