2003-04-29 21:48:04３０１戰役（四）作者： 翁自得 （天理國際智慧財產權事務所執行長） 十二月五日至九日，中美再度舉行一季一次的智財權諮商中，雙方便不歡而散，美方對“投降書”執行進度的緩慢，表示不滿意…… 第二章 意外捲入戰役 烏雲密佈的春天 民國八十一年春天，台灣天空籠罩在美國三Ｏ一巨靈壓頂的一片陰影中！ 為解除四月間已被列入「特別三Ｏ一」優先報復名單的危機，五月十九日修正通過＜著作權法＞後，緊接著，五月底，當時＜經濟部國際貿易局＞局長許柯生率團赴美參加談判，美國這次開出更多的條件，進一步要求我簽訂保護智慧財產權「了解書」！（如附二） 這份「了解書」實際上，就是比＜中美著作權保護協定＞更喪權辱國的“投降書”，我方簽了這份“投降書”後，美國才正式宣布台灣自「特別三Ｏ一」優先國家名單中除名，並終止調查行動。到底我方在“投降書”中做了多大的承諾？否則，美方怎麼會同意除名？ 簡單地說，就是讓出了立法權與行政權，例如，要求在民國八十二年一月三十一日前，通過＜中美著作權保護協定＞及＜有線電視法＞，在民國八十二年七月三十一日前，修正通過＜商標法＞及＜專利法＞等，實施了「舉世所無」的＜電腦出口檢驗制度＞，美方按季「偵訊」我方執行承諾事項的種種情形。 美僑商會演講 繼＜著作權法＞之後，＜中美著作權保護協定＞成為另一個焦點法案，這份美國限期要通過的協定，究竟內容為何？引起我的好奇，不過，當時因忙於第二屆立法委員助選，無暇詳細研究，只是略為瀏覽，即發現內容有問題。 恰巧，那時臺北美僑商會邀請的一場演講，觸發我深入研究＜中美著作權保護協定＞的動機。美僑商會未定演講題目，我考慮＜中美著作權保護協定＞將在立法院優先審議，且已發現內容有問題，於是決定「一舉兩得」，選擇以＜中美著作權保護協定＞為講題，也從此捲入「三Ｏ一」戰爭！ 演講前，我花了整整二個禮拜時間，幾乎可以「不眠不休」來形容研究這份草案的過程。 若非為了這一場演講觸發我鑽研協定，恐怕我也和一般人一樣，察覺不出有那裏出了問題。可以說，沒有這場演講，就可能沒有後來引發喧然大波的「八項保留條款」。 十二月間，三Ｏ一的陰影，並未因六月間我方簽署了“投降書”等待立法承諾而完全解除。 十二月五日至九日，中美再度舉行一季一次的智財權諮商中，雙方便不歡而散，美方對“投降書”執行進度的緩慢，表示不滿意！而對於我方未能承諾依據民國七十八年草簽的著作權保護協定，以禁止著作物真品輸入，亦表示失望。當時代表我國主談的＜經濟部國際貿易局＞局長許柯生曾表示，＜中美雙方對於著作權協定＞中的平行輸入解釋各不相同，以致這次諮商未獲結論。 不論如何，未獲結論，不歡而散的結局，意味著下一年「三Ｏ一」報復夢魘又將再起。 迴響
