301戰役（七）

我私下對丁懋時代表發的牢騷，不知怎的，可能傳進丁懋時代表的耳朵裏。隔天，即被通知在三月九日到辦公室跟他見面。團裏成員當時猜測，丁懋時代表突如其來的點名見面，可能是他的弟弟丁懋松（當時擔任隨團翻譯）反映了我的抱怨……

不像是一個代表團
三月五日啟程赴美前，卻接到口頭告知，美方認為我是立法委員的助理，不能讓我參與談判，實在是非常意外。我只是談判代表團的顧問，並非談判代表，美方的要求，實難理解。尤其，美國的＜著作權局＞是隸屬於國會圖書館的單位，其＜著作權局＞的官員可以參加談判，卻不能讓我參加？連我方談判代表的身分都要干涉，這那是平等的談判？

談判代表團的成員，囊括了＜經濟部＞、＜內政部著作權委員會＞及＜警政署＞、＜法務部＞、＜財政部＞、＜外交部＞、＜新聞局＞等各單位代表三十多人，由甫升任＜經濟部＞次長的許柯生擔任領隊，三月六日即到達華盛頓。但許柯生因事晚一天才到。

甫下飛機，便令人對此行有深刻的感受。

三十多人浩浩蕩蕩代表國家來到華府（美國聯邦政府所在地華盛頓）談判，但是，美國有關單位卻連租一輛專車統一接送的作業也沒有，還是團員們三三兩兩各叫計程車到住宿的飯店。後來台灣駐美經濟組人員針對此事解釋，是因在特區租大車子價格非常昂貴浪費。

一行人住進華盛頓特區的ＯＭＮＩ飯店。

三月七日下午二時，在飯店內舉行團務會議。會前特別提醒代表團的幹部，＜外交部北美事務協調委員會＞代表丁懋時晚上在其官邸設宴，宴請談判代表團的幹部，在行程表上，也列有當天晚上“拜會丁代表”的行程及參加人員的名單。

我按捺不住小聲冒出幾句，已經什麼時代了，沒想到我們駐外單位還如此官僚作風。事實上，從一下飛機，直到進飯店、晚餐、開團務會議，一直未見丁懋時代表露個臉，便已質疑這位駐美代表的誠意。

當時我心想，丁代表再怎麼忙，總該來一下。老實說，談判代表團成員是來為丁懋時「打仗」的，因為談判一旦達成協議，就是由丁懋時代表與＜美國在台協會＞白樂綺主席簽署，成員並非純為各自的業務而來，尤其是，他們還要為丁代表背負「喪權辱國」的指責。如今談判的主要領導人一直未見蹤影，還要代表團的幹部到他的官邸「拜訪」他，這種高高在上的官僚心態，令我相當不能接受。

住進飯店的第一天，團員們便各自散開，有的逛街、有的睡覺、看電視，而自第二天起，所有團員的伙食除非在談判會場內，否則均是自理，各吃各的，王全祿便事先帶了泡麵去，躲在房間裏吃泡麵。

當天同行的，還有許柯生等幾位政府官員。進入丁代表辦公室隔壁的會議室，大家坐定後，駐美經濟組組長潘家聲低聲告訴我，他們在此開會，都遵守一項慣例，其他人先就坐，等丁代表進來時，大家要起立，要等丁代表坐下後，大家才能再坐下。言下之意，似在暗示我，希望我等一下照著做。

潘家聲組長告訴我這些事，我起先感覺十分突然，不懂為什麼。但不久，我就猜測，潘組長這些話是在「暗示」我，希望我能照著做。因為一行代表中，惟有我的身份不是政府官員，可以不甩這套繁文縟節的。

我很不以為然，有意拒絕起立，在大家坐著等丁代表「出場」前的那段時刻，我一直盤算著是否接受這種荒繆官僚的禮儀，但我稍後考慮到潘家聲的立場，對於他處理此事表現的婉轉圓融態度，以及既來此尋求對外談判的一致共識，還是先「團結」一點，心不甘情不願地照做了。

丁代表出現會場後，在場的人全部站起來。不過，丁代表未立即坐下，他頗有風度的走過來向我們握手，與平時習慣做的儀式略有不同。

我永遠難忘，丁代表在會議室見到我的第一句話，劈頭就問，他不知道為什麼立法院對於已承諾美方的協定，還要附帶保留？可知造成他很大的困擾？

丁代表緊接著舉出一個例子說，他跟美國友好的參議員見面時，參議員總是告訴他，目前美國最關切台灣的三個問題，第一是智慧財產權，第二還是智慧財產權，第三還是智慧財產權。說得他總是啞口不言，不知怎麼回答才好。

丁代表口氣相當強烈，我也以不甚緩和的口氣回答他：
「要回答這個問題很簡單，丁代表，您可以反問參議員，我們國家現在已經動用警察國家的手段，用公權力主動介入保護美國智慧財產權，你們如果還不滿意，請告訴我，要如何保護你們的智慧財產權，你們才會滿意？」

丁代表被我這一說，一時間似愣住了，接著才以較緩和語氣，詢問我目前台灣政治生態轉變情形。我告訴丁代表，台灣政治生態已經不一樣了，立法院不再是行政院的橡皮圖章。而且，立法院保留的是超國際標準及不平等與溯及既往條款的部份，難道這些不應該保留？

丁代表回說，假如是這些的話，立法院應該要堅持保留沒有錯，他個人也會如此主張。不過，丁代表語鋒一轉，面對美國可能施以「三Ｏ一」報復，仍表示相當憂心。

特別三零一台灣仍在優先之列

　　劉屏／華盛頓二日電　　美國聯邦貿易代表署一日公布二○○三年《特別三○一》報告及名單，由於盜版行為嚴重，台海兩岸都上榜。中國大陸列入《三○六條款》監督名單，美國隨時可以採取貿易制裁手段；台灣則名列「優先觀察名單」，美國將繼續與台灣磋商。　

　　情節最嚴重的「優先指定名單」，今年只有烏克蘭列名。

　　台灣連續第三年登上「優先觀察名單」中。貿易代表署說，台灣把去年訂為「保護智財權行動年」，並透過立法、加強執法等途徑確保遵守國際規範，但是「這些正面舉措並沒有產生效果，盜版及侵權行為仍然很高，令人無法接受」。報告指台灣是全球盜版光碟最主要產地之一，而使用盜版品的情況也很猖獗，令美國企業界蒙受很大損失。報告說，政府的取締工作不夠專業，也缺乏橫向聯繫，所以成效大打折扣。而對盜版行為的懲處，有的太慢，有的太輕，所以嚇阻效用不大。這種種狀況，「令美國政府十分關切」。報告說，未來一年，美國將繼續與台灣磋商，希望有所改善。　

　　依照美國貿易法案規定，美國將促使名單中的各國採取具體措施以加強保護智財權，同時美國政府也將在未來數月內檢討，決定是否升級、降級，或除名。　

　　今年其他列入「優先觀察」名單的還有阿根廷、巴哈馬、巴西、歐盟、印度、印尼、黎巴嫩、菲律賓、波蘭、以及俄羅斯。

　　今年列入《三○六》名單的是中國大陸及巴拉圭。報告說，中共加強立法及執法，但是盜版情況仍然很嚴重，而且政府缺乏透明化，又缺乏協調，加上貪瀆、專業不足、罰則太輕等因素，取締成效欠佳。
