301戰役（八）談判開始

三月八日上午九點，中美智慧財產權談判正式開鑼，地點在美國華府＜貿易代表署＞。代表團三十多人自飯店分坐數輛計程車，先後到達＜貿易代表署＞。

談判地點就在＜貿易代表署＞一間小小不到二十坪的會議室裏，加上美方代表約四十人擠進裏面，展開冗長的談判，何時能出來，大家都不知道。我與馮震宇則在談判室外守候。談判過程，可說是籠罩在冗長沈重的氣氛中。

事實上，談判前，雙方原已訂妥議程，但談判一開始，所有議題完全由美方一路主導控制，據與會的談判人員說，美方代表想談什麼就談什麼，現在談著作權，但談到一半，美方不想談了，就換別的議題，談專利權。我方與會人員，完全不知道美方接下來要談什麼？所以，只好統統自我關在談判室內，以備美國臨時丟出問題時好立即回話。少數成員受不了室內空氣沈悶，跑出來休息透透氣，或菸癮較大的成員偶而出來抽根菸提神，但抽不到幾口，又被緊急叫了進去！

我印象深刻，有幾次，王全祿急急走出來，說裏面太悶了，快受不了，王全祿以為暫時沒他的事了，但是，美方人員議題左彎右拐，又“急急如律令”地把他叫進去。

還有一次，＜法務部檢察司＞司長陳耀東從小房間裏氣極敗壞地走出來，手裏拿著一份資料，臉色十分難看。我問陳司長，發生什麼事了，陳司長帶氣回說，美方現在要我們提供取締侵權的原始資料，怎麼可能呢？陳司長表示，取締的資料有一大堆，怎麼提供呢？

我看著陳司長緊張的神色，心裏有頗大感觸，但我仍以開玩笑口氣對他說：
「哦！你今天好像是來接受偵訊的」。

陳司長聽了苦笑，我接著，你們檢察官以前在台灣是專門偵訊犯人的，但今天你似乎是代表中華民國到美國接受美方「偵訊」！

後來雙方協調此議題的結果是，照美方提出的表格設計，要中英文對照，而必須填具的項目全部由美方擬訂。

不是談判，是接受偵訊！
事實上，我方取締侵權及執行保護的成績如何，是這次談判的主要議題，這是延續民國八十一年六月五日中美雙方簽署的「了解書」規定而來，其中美方針對我方應達成的執行績效一一訂出執行時間表。這次談判到，美方就是在算這份「了解書」的總帳，在談判桌上對照檢查，檢查我方是否有照著執行，包括電腦出口檢驗制度、取締侵權第四台等。其中，或有我方聲稱已執行完成，但是，美方認為提具的資料不夠完備、不足採信者，美方仍要求我方再提具資料以「證明」確實執行。

每位走出談判室的我方代表，均表情凝重、搖頭指出「美國人太兇悍了」！其中尤指美國＜貿易代表署＞一位女性法務人員 CATHERINE FIELD ，咄咄逼人，特別兇悍。

整個談判過程，就像是接受美方一場場偵訊，我方毫無招架能力，也無說話餘地。這那裏是談判呢？三十多人代表團來到美國可說是尊嚴全部掃地，是來接受美方的偵訊。這是我第一次赴美談判的感受！

會外戰
由於我被美方拒絕參加談判，美方可能了解＜中美著作權保護協定＞附保留條款來自林壽山立委與我幕後的主導，有意了解我的意見如何，因此，接受我國駐美經濟組的建議，於三月十一日中午，我以林立委助理的身分，與美方主談人美國＜貿易代表署＞助理代表Robert B. Cassidy等五人，非正式溝通了兩個多小時。

我方與會人員包括＜內政部著作權委員會＞王全祿主任委員、＜北美事務協調委員會＞經濟組潘家聲組長等六人，在會談過程中，不僅發現美國官方及業者均誤解＜中美著作權保護協定＞第十四條的條文，且對美國官方解釋協定第十三條的「合理使用」條款，可以適用於第十四條之疑似「禁止真品輸入」，尤覺不可思義，更感受到美方只要經貿利益，不要民主法治的戰略。

我還特別提出同樣的問題，我們國家現在已經動用警察國家手段在取締了，我不知道我們究竟要怎麼做，你們美方才會滿意？那天出席的＜貿易代表署＞官員CATHERINE FIELD火氣十足的回答我，她說，我們就是因為你們台灣盜版太嚴重，是「海盜王國」！所以我們當時才對你們提出要求，所有侵害智財權的人統統要以「非告訴乃論罪」來處理。

這位女士好像認為我國人民都是無可救藥的犯人，美國非得使出嚴刑峻罰，否則不能治，我當場毫不客氣的反問她，難道說，我寫了一首歌，想讓大家都可以自由去唱，也不可以？你們還要叫警察問唱的人，有沒有我的同意書？這像是一個法治國家？我提這個問題時，心裏是想，我不是政府官員，不怕得罪妳，你們有什麼不對，我照樣講！

這位＜貿易代表署＞的女官員似被我強硬的反擊問住了，一時間，不知如何對答，場面頗為僵硬！

沈默好一會兒，＜美國在台協會＞的代表RAYMOND SANDER 打圓場，說現在我們不要談執行的問題，才將話題給岔開。

談判最後，美方提出一份「 record of understanding 」草案（如附五）要求我方接受，這份備忘錄就是要解決禁止真品輸入問題，因我方代表來不及研究備忘錄的影響，且隔日美方已有與他國談判的行程，因而未達成協議，三月份的談判隨即結束。
