這干台灣勞工“屁事”？

外國籍勞工工資得低於法定基本工資？
4月16日，立法委員黃宗源、林正二、周雅淑、楊瓊瓔、陳建銘、蘇盈貴、楊仁福、廖本煙、柯淑敏、侯水盛、唐碧娥、羅世雄等五十二人，提出＜勞動基準法修正案＞送交立法院＜程序委員會＞，該修正案主要內容如下：

＜勞動基準法＞第二十一條原條文：
工資由勞雇雙方議定之。但不得低於基本工資。
修正條文：
工資由勞雇雙方議定之。但本國籍勞工工資不得低於基本工資。

乍看之下，修正條文只是在原條文增列了「但本國籍勞工工資」八字，好像是多此一舉，其實，大大不然！因為，增列了本國籍勞工，其實就是排除了外國籍勞工，亦即，外國籍勞工的工資得低於法定基本工資15840元！

這干台灣勞工“屁事”？
或許，基於本位心態，台灣勞工朋友們以為這干咱“屁事”？試想，一旦外國籍勞工工資得低於15840元，那麼，台灣企業財團為了壓低工資成本以追求最高利潤，必定更大舉更加快地「進口」外國籍勞工，以取代台灣勞工，屆時，減薪、裁員、失業與過勞死，將是台灣勞工大眾的唯一命運！

事實上，在外國籍勞工工資不得低於15840元時，每年「進口」外國籍勞工人數已不斷激增，台灣失業者陣營就日益“壯大”，根據官方統計，目前外國籍勞工人數已達三十多萬，若加上「非法」引進的外國籍勞工，應不少於四十萬！

所以，上述＜勞動基準法修正案＞若在立法院完成三讀，就賦予資方任意削減外國籍勞工工資的「合法」權力，在無最低工資的限制下，外國籍勞工不但成為雇主、廠商、財團與人力仲介公司逐利的“最愛”，而且，還是被資方用來對付台灣勞工的「致命」武器，以脅迫台灣勞工接受愈來愈苛薄、惡劣的勞動待遇！

更要命的是，當失業者陣容日益“壯大”，當薪資收入減少，就造成台灣總體消費能力的急劇降低，促使台灣內需市場更趨蕭條，肇致大量倒閉、關廠與裁員，而又再產生失業，如此惡性循環不已，到頭來，受害者還是台灣勞工本身！

此外，增長的失業人口必然加重社會福利預算支出的需求，在國家財政赤字的嚴峻危機下，扁政權因對企業財團拼命減稅，就只好不得不向勞工徵稅，如健保雙漲，到頭來，受害者還是台灣勞工本身！故而，即使從本位心態出發，即使從自利的觀點考量，台灣勞工也應積極反對取消外國籍勞工的最低工資限制。

對外國籍勞工採歧視待遇是違反國際公約！
而從台灣意圖國際化的角度以觀之，我國已分別於1930年及1961年，正式簽署了＜國際勞工組織＞的＜最低工資公約＞、＜歧視（就業與職業）公約＞、第97號公約與第111號公約，這些公約皆明文規範，各國政府政策法令對於外國籍勞工之雇用不得採取歧視待遇，這當然包括薪資的歧視。

台灣爭取多年才加入的ＷＴＯ，也標示一項基本原則，即對待其它會員國必需遵守「國民待遇」原則，也就是不能對待本國勞工薪資是一套標準，對待外國籍勞工是另一套標準！如果，台灣政府對於正式簽署的國際公約可視為虛文，如果，台灣政府對於ＷＴＯ的基本規範能置之不理，那麼，台灣政府口口聲聲宣稱「要與國際接軌」就是睜眼說瞎話！那麼，台灣政府矢志要突破外交困境，追求國際地位的說法，更是天大的謊言！

違反經發會共識！
在民國90年8月26日扁政權所召集「經發會」的就業組會議中，共同意見編號410801項，就明示「我國即將加入ＷＴＯ，基於公平原則，基本工資不應排除外勞之適用」原則性共識。

扁政權信誓旦旦要落實「經發會」決議，卻利用ＳＡＲＳ吸聚所有社會關注焦點的有利時機，企圖偷渡明顯違反「經發會」共識的＜勞動基準法修正案＞，這即可充份證明，所謂「經發會」根本就是一場騙局！

台灣人民要肯定外國籍勞工對台灣的巨大貢獻！
不管人們對外國籍勞工的主觀看法為何，但是，無庸置疑地，這幾年來，外國籍勞工對於台灣經濟成長、公共建設、家庭照顧、醫療看護．．．．．等各方面，付出無數的青春、血汗與生命，提供了巨大的貢獻！

所以，不論基於自利本位心態，還是顧及台灣人權的國際觀感，或從道義的立場來說，台灣勞工都應義無反顧地和外國籍勞工站在一起，共同反對立法委員黃宗源等五十二人所提出的＜勞動基準法修正案＞！
