2003-06-20 19:29:25法務部接管學術，陳青天「端正學風」！？（中）■作者：鍾瀚樞 東海大學歷史研究所二年級／＜新社會學生鬥陣＞召集人 一般來說，對於一個學者在學報上公開發表的論文，當然任何一個普通讀者都有權提出建議或者批評，因為言論自由並非學者特權，而是基本人權。但是，我們都知道，＜法務部＞部長可不是普通的讀者，在＜法務部＞轄下，掌控了兩所執行「國家暴力」的機構，一是司法檢察單位＜地檢署＞，二是情治單位＜調查局＞，因此，＜法務部＞其實是國家機器遂行「合法」暴力統治的鎮壓性機構，而＜法務部＞部長則是首長。 因此，在一個民主國家裡，難一個落實人權保障與學術自由的政治體制中，誰都可以對孫教授的文章提出批評，但是，包括＜法務部＞部長在內的「國家暴力」諸機構就是不能批評！因為，一旦＜法務部＞部長發動批評，則不管其主觀意願為何，客觀上就已經不祇是批評，而是＜法務部＞部長挾恃可怕的「國家暴力」進行政治威嚇，以鎮壓學術自由！ 然而，我們的陳青天，竟然連這點簡單的道理都不懂嗎？或者，陳青天根本就是明知不應為而為之呢？假如，答案不幸為後者，則此後，台灣學術界豈不重回蔣家王朝時代的「噤若寒蟬」？從檢察官率領警察違法侵入成功大學學生宿舍以搜查MP3事件的開始，到今天＜法務部＞陳部長公然干涉威脅學術創作的自由，我們難道不足以合理地推測：另一波新的「白色恐怖」風潮，其實已經悄然地在我們所熱愛的島嶼上蔓延、展開了！？ 根據《聯合報》記者王文玲的報導，政治大學孫善豪教授的論文之所以讓陳部長「閱後大怒」，原因之一是因為孫教授「不明瞭著作權修法過程即出言批評」，但是，既然陳部長認為，孫教授是在不清楚整個修法的過程、事情的原委、政府的苦衷的情況下，撰文批評政府施政，因而覺得很委屈，那麼＜法務部＞為什麼不能將《著作權法》的修法過程完整而公開、具體而透明地公諸於世，接受台灣人民的公評呢？ 換句話說，當陳部長在指責孫教授不瞭解政府推動修法過程的同時，不正同時再度地突顯出，政府在涉及對美國帝國主義進行貿易談判的過程時，總是不願意面向陽光、面向台灣人民，總是一貫地壟斷資訊，似乎寄望透過黑箱作業、密室決策的方式來瞞天過海嗎？ 「著作權法的主管部會是＜經濟部＞，＜經濟部＞提案修法擴大公訴罪的範圍時，＜法務部＞始終反對，不過行政院整體考量後，接納＜經濟部智慧財產局＞的版本，送請立法院審議，並非＜法務部＞想把盜版改為公訴罪。」 陳部長對記者的這番表白，真是讓我這個當年在高中時代，曾因在學校揮舞他參選省長的競選旗幟，而遭到校方「關切」、警告的崇拜者失望透頂！ 彼時，我們這些年輕人，之所以會「死忠」支持陳定南先生參選省長（上課時間還把陳定南的競選旗幟插在教室前面，惹得教官氣沖沖地跑來拔掉，然後狠狠地警告我們班，把全班痛罵一頓！），就是因為崇拜這位擁有「陳青天」美譽的民主鬥士，於擔任宜蘭縣長時代的清廉、勇氣、熱情、魄力和正義感，不僅隻身對抗台塑集團、力拒六輕設廠宜蘭，還創造出獨步全國的宜蘭「冬山河經驗」！ 但是，這位當年「願同弱少鬥強權」的民主戰士陳青天，既然對《著作權法》改為公訴「始終反對」，為什麼會如此輕易就放棄立場呢？為什麼不堅持原則而不惜辭官？還是說，陳青天雖然敢力抗台塑六輕，向王永慶先生說不，但是，一遇上微軟壟斷集團、遇上偉大的比爾‧蓋茨總裁、遇上美國霸權的脅迫，就腿軟、就原則盡棄了呢？難道說，陳青天在當上法務部長之後，當年的清廉、勇氣、熱情、魄力和正義感，都像日本的那部電影一樣「人間蒸發」了嗎？（明日待續） 由 cyberbees 發表於 June 20, 2003 07:29 PM | 引用迴響
