如何準備一場罷工？

這是人人都無法否認的事實，在營利的公司企業中，勞資關係是絕無民主而又如天差地別般的不平等，這勞方不管是在生產現場的藍領階級還是坐辦公室的白領階級，都是分秒戰戰兢兢、被迫卑躬曲膝的受雇者，也都是創造利潤的最大功臣與分得最少報酬的苦勞工奴，資方可以對勞方恣意咆哮、斥辱、調職、減薪與開除，而勞方連法律所保障的組工會權利也時遭扼殺與鎮壓！

當法律的天平一面倒向資方，當政府由資方集體所控制，當民意代表就是資本家集團所豢養的「民主」走狗，罷工，便是受雇者防守保衛自己權益的唯一有效武器了，在歐洲、美國與日本、韓國等先進資本主義國家，罷工是家常便飯，從國際新聞頻繁的罷工消息，連最不被認同的公務人員也經常發起罷工行動，便知罷工不僅是民主指標、進步表徵，而且已融入人民生活一部份了，法國媒體表示，罷工是法國人的第四餐。

但是，罷工在台灣卻極為罕見，若有，也常暴起暴落，短短幾天就被資方與政府用各種手段瓦解！

我剛到菲律賓時，便對菲律賓工會豐富的罷工經驗感到驚訝，幾乎各工會都有幾次罷工的經驗，有成功也有失敗，但他們從中吸取了更多的經驗，也花很長時間（往往是一兩年）進行準備，若資方再有侵犯工人權益的情事，便能發動罷工！目前，就有許多場罷工正在進行著。

到底他們如何準備一場罷工呢？怎樣才能成功地展開罷工，爭得工人應有的權利呢？以下是我與菲律賓中呂宋地區工聯主席閒聊，談及此一問題時的隨手筆記，並不是什麼制式化的工作守則，但或許能提供台灣受雇者參考。

□罷工準備程序：
一．析勞資爭議的議題，深入訪問調查；建立工人罷工抗爭的社會正當性。
二．與工會中積極核心成員開會，小組運作，並擴大工會會員的勞工教育。
三．重新整編工會中的積極份子，由原有的核心小組加強聯繫、教育。
四．在工會與勞工群眾中組建各種委員會，並安排核心成員加入而領導之。
五．先發動小規模抗爭，進行小型勞資爭議。
六．等到工會會員在思想上、組織上等各方都準備成熟，就著手推動大罷工。
七．罷工抗爭後，再重新整編核心小組。
八．在罷工線上組建各種委員會，安排核心小組成員加入以領導之。
九．同時準備「違法」抗爭（工人罷工鎖場在菲律賓是違法的）：要做好因應資方與政府聯手暴力鎮壓的對策與一切。
十．和其他契約工進行溝通，說服他們在罷工期間不要上工。依菲律賓勞動法令限制，契約工依法不能參加工會，但也有些較強大的工會突破法令限制，把契約工納入工會會員。
十一．要和工人的家庭成員進行溝通，盡力取得支持。
十二．設置對外聯絡窗口，建立連線以團結律師、教會、農民等等社群支持工人的罷工抗爭行動。
十三．罷工不要太長，要確保壓力集中打擊資方。方法有三：
1＞聯合其他社群共同施壓；
2＞確保封鎖工廠大門；
3＞對政府部門施壓。
十四．每座工廠營運狀況不同，處理方法與罷工策略也隨之改變，如容易關廠、落跑的紡織廠與持續經營的大公司大財團，兩者差異就很大。
十五．政府出面協調時，若資方同意訴求，則可以簽字停止罷工。
十六．要把全部的工人領袖都安排進罷工的重要工作職務，否則，就會被資方利用、分化。
十七．要組織工廠週遭社區居民，以在罷工期間支援工會各種所需。

□公家單位罷工有些不同：
一．公家單位不具有勞資團體協約制度。
二．公家單位工人的勞動條件，視政府的政策、法令、國家預算而變化。
三．因此，公家單位的工人權益議題是公共政策議題，若要罷工，一定要團結社會上其他公民社群，以爭取向雇主即政府聯合施壓。
四．在私人公司或有一定的程序可允許合法罷工；公家單位則不必理會這些行政程序，因為，菲律賓的所有公家單位都禁止罷工。
五．公營事業與公共服務部門的反私有化議題，一定要揭露其公共政策的性質，引起公共討論，而不能設限於受雇者權益的狹窄範圍。

聽不懂就直接講請教我嘛!! 為什麼老子會這麼說?! 你的論點只能成立在"勞方永遠只能當勞方",而"資方永遠佔上方而為資方"的情況!! 而且,你"竟然"弄不懂一件極為明顯的事實! 金字塔頂端的有錢人永遠是極少數,也就是說"所謂的消費者,其實也就是占絕大多數的勞方"!!

也就是說勞方=消費者!! 而又要「勞資合作爭取顧客」,這就能制衡資方了!! 因為在理想型態之下,勞方跟顧客是一體的,而只有資方需要爭取顧客! 也就是說資方須要勞方工作,還需要勞方來消費!! 可是當你沒有爭取到客戶認同而罷工的時候,很抱歉,勞方跟消費者分劣! 而你將跟資方同舟共濟,消費者會背棄你們!! 然後你們一起失業,一起去找新工作!! 如此罷了!!

所以老子說

這還是客氣的說法哩!! 因為勞方會被資方所宰割只能發生在一個情況之下,那就是"你沒辦法換工作"!! 或者"換工作對你更不利"!!! 只有在這樣的情況之下你才會選擇對抗資方,而不是選擇換工作!!

所以,英明的政府應該提供進修管道讓工人得以順利轉換工作,而在進修期間給與補助,如此一來,即可制衡資方!! 因為資方如果真的對勞工惡劣,而導制無人欲當該廠勞工,那最後自己也只能關門大吉,或自己下海當勞工! 如若政府又提供方便實惠的小額創業貸款,那資方就更不敢對勞方予取予求了!! 因為隨時會豬羊變色!!

這才是真正的解決之道!!

我之所以沒有明講[勞方會被資方所宰割只能發生在一個情況之下,那就是"你沒辦法換工作"!! 或者"換工作對你更不利"!!!],那是給作者留面子,因為這樣一來就已經可以開始合理懷疑菲律賓有部份的工會根本就是擺明了以罷工訴求行勒索資方之實了!!

老實說,這就是為什麼菲律賓之所以困苦的另一個原因,菲律賓的罷工問題是國際聞名的,手上有錢的大財團誰敢去菲律賓投資? 兄臺之前的文章竟然睜眼說瞎話,講啥菲律賓的法令對罷工不利? 罷工到世界聞名沒人敢去投資竟然還說法令對罷工不利? 阿不然兄臺覺得怎樣才有利?

須知勞資雙方是合作關係,而不是對抗關係,為什麼台灣罷工問題不嚴重? 因為台灣很多中小企業家族企業,很多人校長兼撞鍾,罷啥工? 而且台灣是出口導向,你台灣罷工,立刻就會被國際上其他地方取代,你罷工呀!! 所以,會罷工的企業基本上在台灣是活不下去的! 不是被罷工搞垮,而是因為競爭力輸人家,收不到訂單,被市場直接淘汰掉的!

台灣的問題是政府的法令不健全,一堆象牙塔法令,根本不能落實! 這個問題才重!

請問這跟惡意罷工勒索資方有何不同? 如何界定? 憑啥說你勞方罷工一定有理?

兄臺的思想非常的偏頗不切實際,勞資雙方是合作關係不是對抗關係,你的對抗型態勞資關係只適用在百年保守大企業橫行的歐美地區,根本不適用在變動快速輕薄短小企業為主的地區,但是你卻不知道這件事,而且還以為應該放諸天下皆準,竟以為台灣落後,真是蠢弊了!!

我只是點破你們的思考邏輯問題所在而已,你可以不承認我所指出的問題,繼續以同樣的邏輯運作思考,可是,菲律賓不會有所不同!!

那我也來個老實說好了!老實說,在這邊能常常看到這位兄臺的天兵留言,也實在為瀏覽網站憑添許多意想不到的笑料啊!

你去問問那些被逼上絕路,走上街頭抗議,或圍廠或罷工的勞工們,他們跟老闆的關係是合作還是對立好了!或者等你去做了幾個月工廠勞工,你再來跟我們談談,你跟你老闆的關係,到底是合作還是對立好了.你講的話,簡直不是"何不食肉糜"可以形容的.
