301戰役（十七）

研討會風波

民國八十二年六月十五日，由＜經濟部＞主辦的「中美智財權近年之衝突與解決方向」研討會，邀請華盛頓大學法學教授劉江彬主講，在研討會書面資料第四頁指出「美方代表對臺灣的觀點」中有「b．立法委員助理誤解法律」、「f．行政與立法未能配合」，所指立法委員助理顯然就是指我本人！

因為立法委員助理與美方談判代表會談的只有我一人，因此，我在會中先「自首」，但不作辯解，只建議劉教授能夠研究＜中美著作權保護協定＞立法院的附保留條文與理由，再對照研究美方在三月談判對保留理由提出的書面批評，就能了解是誰誤解？

未料，這場研討會只是＜經濟部＞委託劉教授研究「美國企業對智慧財產權相關立法與談判策略之影響研究」內容之一。

九月十四日，＜經濟部＞主辦「美國智慧財產權最新發展與國際協商策略」研討會，邀請的主講人除了劉江彬教授外，尚有甫離職的聯邦教育官員、馬里蘭大學法學博士孫遠釗及前聯邦參議員顧問暨資深助理、哥倫比亞大學法律博士胡漢權律師。

在這場研討會中提出「美國企業對智慧財產權相關立法與談判策略之影響研究」摘要版書面報告的第六十九頁再度指出：“立法委員助理法律素養不夠或誤解法律”、“行政與立法未能配合”，另外，在第七十六頁也指出“政治秀，慷慨激昂，痛哭流涕，趁機表演”。更在第八十一頁認為，臺灣目前有十大缺失，其中第十項是“立法機關助理制度有待加強”！？

只因我的法律素養不夠，就將“立法機關助理制度有待加強”列入十大缺失之一？我在＜經濟部＞真的是很惹人厭！

會中，我還是再度「自首」，但建議指名是我，不要去連累其他法學素養高的助理，因為我非法律科班畢業，法學素養不夠的指責我可以接受，但「誤解法律」顯然是指＜中美著作權保護協定＞的保留條款與理由，而保留條款與理由已受到國內學界的肯定，若我承認「誤解法律」，等於是國內學界「誤解法律」，我當場表示不能接受。

雖然，這些批評是照錄美方代表的話，但學者有責任加以分析，判斷是非，尤其是，顯然已涉及「人身攻擊」，否則，學者要蓄意「借刀殺人」，太容易了。

後來，我以電話告訴＜經濟部＞主辦研討會的處長，若我九月三十日與美方代表見面時，詢問本案，而美方否認時，＜經濟部＞如何交待？當然，我不可能如此做，只希望＜經濟部＞今後審查類似的研究報告時，能特別注意。

這份報告大部分的內容的確有助於談判策略的研擬，但第六章談到「本國企業因應之策略與建議」，我的感覺就像紙上談兵，與中美談判實務脫節，因此，特別建議劉教授，將這份報告先交由我國相關談判代表研究，並與他們座談，根據他們的經驗再修正。

這章雖名為「本國企業因應之策略與建議」，內容則等於是「我國因應三O一之策略與建議」，換言之，就是談三O一的戰略，既然是戰略，研擬人應該要有實際作戰的經驗，若是由沒有實際作戰經驗的學者所研擬，至少應該聽取有實際作戰經驗的人的意見，否則，會淪為空談。

例如，這份報告指出的十大缺失，我曾詢問研究人，香港有沒有這十大缺失？香港的仿冒問題嚴不嚴重？若有，為何連「三O一」的一般觀察名單也未曾上耪？如此研究結果豈非矛盾？

接著發言的業者代表呼應我的問題，舉出香港仿冒問題嚴重的案例。研究人在臺上的答覆很簡單，「不需要再聽取有實際談判經驗的人的意見，因為旁觀者清」、「香港可能是九七大限的政治問題，所以未曾上榜」。

聽到如此答覆，我也只能無奈的苦笑，畢竟自己不過是專科畢業。但會後，孫遠釗博士卻私下問我，香港從未列名三O一的原因？我心想，你是已宣誓「效忠」美國的華裔，我怎能坦白告訴你這項戰略？當然委婉拒絕了！（待續）
