2003-10-01 00:13:34反對只見「疾病」不見「勞動」的職業病認定～工醫合作，防治職病編按：＜蜂報＞投稿，全文照登 聯合陳情單位： 過去數十年來，職業病在官方的數據中，去除掉塵肺症礦工，每年幾乎只有寥寥百例！相較於台灣每年高達五、六萬例的職業災害，職業病少得離奇；再相較於歐美日等國家每年上萬病案的記錄，台灣職病率更是少得可疑！ 在台灣，整個職業病通報、調查、認定、補償體系未曾建立，可想見的，多少下背痛、失聰、有機溶劑致癌、過勞症的工人默默受苦，而不受照顧。職業病成為一個不可深究的大黑洞。 職業病不只是醫療問題，更是社會問題。職業病的認定原本就是勞政主管機關的職責，但職掌職災保險的勞保局，卻將責任全推給職病醫師，一旦工人對職災給付的審查有異議，官方便躲到醫師背後：「這是專科醫生認定的。」拿專科醫師當擋箭牌，迴避行政責任，也拒絕工人列席說明。 實務上，醫師雖然瞭解流行病學的致病因子，但對於勞僱關係與勞動現場卻是一無所知，更缺乏足夠的時間人力實地進入勞動現場進行訪察；種種限制讓醫師不得不傾向保守態度，結果卻是罹病勞工難以獲得職災給付。工會幹部與勞工最清楚勞動現場的種種細節、勞動流程中細緻的管理控制、勞動環境裡有形無形的危機，然而在現行制度中，就算工人懷疑他的工作可能造成職業病，卻沒有任何的管道可以提出。 長期以來，職業病的審查、認定權力，掌握在官方、醫界的手中，工傷當事人及基層工會，完全沒有參與的空間。職業病不只是「疾病」，不能忽略「勞動」關連的面向。我們反對現行由醫界「全包式」職病防治制度！官方應負起行政裁決權，將「醫學」與「勞動」二大領域等量看待，由工會與醫界合作，共同參與職病預防與認定的重要工程！ ■在預防職災方面： 2．研究權：工會在勞動現場發現「疑似職業病」，得申請官方補助研究，國家應釋出資源協助，進行以工會為主體的研究調查。 ■在認定職病方面： 職業病的黑洞唯有工醫合作，才能讓真實的案例具體浮現。有了案例，才會促進台灣職業醫學的發展與研究。而工會積極參與職病調查，也才能真正為勞動現場的安全衛生把關。 由 發表於 October 1, 2003 12:13 AM | 引用迴響
